StoneOne Corp Text Alert Service - SMS/Text Messaging Terms & Conditions

These SMS/Text Messaging Terms & Conditions ("SMS Terms") govern participation in the StoneOne Corp Text Alert Service and text messages sent by or on behalf of StoneOne Corp ("StoneOne," "we," "us," or "our").

These SMS Terms apply to customers, prospective customers, property owners, contractors, authorized project contacts, and other individuals who affirmatively agree to receive project-related text messages from StoneOne.

These SMS Terms supplement the StoneOne Privacy Policy.

1. StoneOne Text Alert Service

StoneOne's Text Alert Service provides customer-service and project-related SMS and MMS communications concerning StoneOne products, services, appointments, and customer projects.

Messages may include:

  • Template scheduling and confirmations;
  • Installation scheduling and confirmations;
  • Service-call scheduling and confirmations;
  • Appointment reminders;
  • Schedule changes;
  • Delivery or installation coordination;
  • Project-status updates;
  • Requests for information necessary to complete a project;
  • Notifications concerning the status of materials, products, or services;
  • Communications concerning measurements, templates, fabrication, installation, delivery, or service;
  • Responses to customer questions or requests; and
  • Other important communications directly related to an existing or prospective StoneOne project, product, or service.

StoneOne's Text Alert Service is not intended to be a marketing or promotional text-message program.

2. Consent to Receive Text Messages

Customers may voluntarily enroll in StoneOne's Text Alert Service by providing their mobile telephone number and affirmatively consenting to receive text messages.

StoneOne may obtain consent through:

  • A customer inquiry sheet or other paper form completed at StoneOne;
  • A QR-code enrollment form available in the StoneOne showroom;
  • An enrollment form available through StoneOne's website; or
  • Another affirmative opt-in method permitted by applicable law.

By providing your mobile telephone number and affirmatively consenting to StoneOne's Text Alert Service, you agree to receive SMS and/or MMS messages from StoneOne at the telephone number you provided regarding the StoneOne project, product, service, or appointment associated with your consent. Messages may be sent manually or through an automated messaging system or other messaging technology.

Consent to receive text messages is not required as a condition of purchasing any goods or services from StoneOne Corp. If you choose not to participate in the Text Alert Service, StoneOne may communicate with you through other available methods, including telephone or email.

3. Project-Related Messages

Text Alert Service messages may relate to your template or installation appointment, service-call appointment, project schedule, delivery, fabrication or project status, appointment changes, project requirements, customer-service request, or another StoneOne project-related matter.

Examples include:

  • StoneOne: Your template appointment is scheduled for Tuesday with an arrival window of 10:00 AM-12:00 PM.
  • StoneOne: Your installation is scheduled for Friday with an arrival window of 8:00 AM-10:00 AM.
  • StoneOne: Reminder - your template appointment is tomorrow. Your arrival window is 12:00 PM-2:00 PM.
  • StoneOne: Reminder - your installation is tomorrow. Your arrival window is 8:00 AM-10:00 AM.
  • StoneOne: We need to change your installation arrival window. Please contact us to confirm the updated schedule.
  • StoneOne: Your project is ready for the next step. Please contact us to schedule your template appointment.
  • StoneOne: Please contact us regarding an update to your project.

These examples are illustrative only. Actual messages will depend upon the status and requirements of the customer's project.

4. Two-Hour Arrival Windows

StoneOne schedules template and installation appointments using a 2-hour arrival window rather than an exact arrival time. For example, an appointment may be scheduled with an arrival window of 8:00 AM-10:00 AM rather than for an exact 8:00 AM arrival.

A 2-hour arrival window identifies the period during which StoneOne expects its representative, template technician, installer, or other applicable personnel to arrive. Arrival windows are estimates and may be affected by project conditions, conditions encountered at prior appointments, traffic, weather, access issues, equipment or vehicle issues, emergencies, delays outside StoneOne's reasonable control, or other circumstances affecting the day's schedule.

StoneOne will make reasonable efforts to notify customers of material scheduling changes. A 2-hour arrival window is not a guarantee of an exact arrival time.

5. Message Frequency

Message frequency varies based on your project and scheduling needs. Customers may receive multiple text messages during the course of a project, particularly during template scheduling, fabrication, installation, service, delivery, or other active project stages. The number and frequency of messages will depend upon the individual project and the communications reasonably necessary to coordinate it.

6. Message and Data Rates

Message and data rates may apply. Your mobile carrier's messaging, data, and other charges may apply to text messages sent to or received from StoneOne. StoneOne is not responsible for charges imposed by your wireless carrier. Contact your wireless carrier for information regarding your individual wireless service plan.

7. How to Opt Out

You may withdraw your consent to receive StoneOne Text Alert Service messages at any time. Reply STOP to opt out. StoneOne will also honor other clear and reasonable requests to stop receiving text messages as required by applicable law.

Recognized opt-out words may include:

  • STOP
  • QUIT
  • END
  • CANCEL
  • UNSUBSCRIBE
  • REVOKE
  • OPT OUT

A consumer may also communicate a clear request to stop text messages through another reasonable method where required by applicable law. StoneOne will process valid revocation and opt-out requests as promptly as reasonably practicable and within the timeframe required by applicable law.

After an opt-out request, StoneOne may send one final non-marketing text message confirming that the opt-out request has been processed, where permitted by applicable law. After the opt-out has been processed, StoneOne will not send additional Text Alert Service messages covered by the opt-out unless you subsequently provide consent to receive text messages again.

Opting out of text messaging does not cancel an existing StoneOne order or contract, a scheduled template, installation, or service appointment, or terminate an existing StoneOne project. If communications remain necessary concerning an active project, StoneOne may contact you through another lawful communication method, including telephone or email.

8. Help and Customer Support

Reply HELP for help. You may also contact StoneOne using the customer-service telephone number or email address provided on the StoneOne website.

9. No Marketing Consent

Consent to StoneOne's Text Alert Service applies to project-related and customer-service communications described in these SMS Terms. Your enrollment does not provide StoneOne with consent to send unrelated advertising or promotional text messages. StoneOne will not interpret consent to receive project-related messages as consent to participate in a separate marketing or promotional SMS campaign. If StoneOne establishes a separate marketing or promotional text-message program in the future, StoneOne will obtain any separate consent required by applicable law.

10. Your Mobile Telephone Number

By enrolling in the StoneOne Text Alert Service, you represent that your mobile telephone number is accurate, you are the subscriber, customary user, or otherwise authorized to provide consent for communications at that number, and you have authority to consent to receiving text messages at that telephone number.

If your telephone number changes, is reassigned, disconnected, transferred, or is otherwise no longer under your control, please notify StoneOne as soon as reasonably possible. StoneOne is not responsible for messages received by another individual because a customer failed to notify StoneOne that a telephone number had changed, transferred, or been reassigned.

11. Privacy and Mobile Information

StoneOne's collection and use of personal information is governed by the StoneOne Privacy Policy.

In connection with the Text Alert Service, StoneOne may maintain your name, mobile telephone number, project or service information, the date, time, and method through which consent was provided, a record of the applicable consent, communications between you and StoneOne, message-delivery information, HELP requests, opt-out requests, and records reasonably necessary to document and administer your messaging preferences.

StoneOne does not sell, rent, trade, or share your mobile telephone number or SMS opt-in information with third parties or affiliates for their own marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes.

StoneOne may use service providers that assist with the technical delivery or administration of its communications. Those providers may process information only as reasonably necessary to provide services to StoneOne and are not authorized by StoneOne to use customer mobile numbers or messaging-consent information for their own marketing or promotional purposes.

12. Financial and Sensitive Information

StoneOne does not use its Text Alert Service to request bank account numbers, credit card numbers, debit card numbers, Social Security numbers, financial account passwords, account login credentials, or similar sensitive financial information. Please do not send Social Security numbers, banking credentials, payment-card information, passwords, or other unnecessary sensitive information through text message.

13. Message Delivery and Availability

Text-message delivery depends upon your wireless carrier, mobile device, network availability, telecommunications providers, and other systems that may be outside StoneOne's control. StoneOne does not guarantee that every message will be delivered or received within a particular period. Carriers are not liable for delayed or undelivered messages.

StoneOne is not responsible for failures or delays caused by wireless carriers, network outages, incorrect or disconnected telephone numbers, device settings, spam or message filtering, telecommunications system failures, internet or technology failures, or circumstances outside StoneOne's reasonable control. StoneOne may use telephone, email, or another communication method when reasonably necessary.

14. Security of Text Communications

SMS and MMS messaging are not guaranteed to be secure or encrypted methods of communication. Customers should not transmit confidential financial information, passwords, Social Security numbers, or other highly sensitive information through text messages. StoneOne uses reasonable safeguards consistent with its Privacy Policy to protect information maintained in connection with its business operations.

15. Changes to These Terms

StoneOne may update these SMS Terms periodically to reflect changes in applicable law or regulation, Federal Communications Commission requirements, messaging-industry or wireless-carrier requirements, technology, StoneOne's messaging practices, or StoneOne's business operations.

The current version will be posted at www.StoneOneCorp.com/terms. The applicable effective or updated date will appear at the beginning of the Terms. Material changes will be communicated when required by applicable law.

16. Federal and Massachusetts Compliance

StoneOne intends to administer its Text Alert Service in accordance with applicable federal and Massachusetts laws, regulations, and consumer-protection requirements, including, where applicable:

  • The Telephone Consumer Protection Act (TCPA);
  • Applicable Federal Communications Commission (FCC) rules and orders;
  • Federal requirements concerning consent and revocation of consent;
  • Massachusetts General Laws Chapter 159C concerning certain telephone solicitations and consumer communications;
  • Massachusetts General Laws Chapter 93A concerning unfair or deceptive acts or practices; and
  • Other applicable federal and Massachusetts consumer-protection and privacy requirements.

StoneOne's Text Alert Service is intended for customers and other persons who have affirmatively agreed to receive project-related communications and is not intended to operate as an unsolicited telemarketing campaign. Nothing in these SMS Terms is intended to waive any right or protection that cannot lawfully be waived.

17. Relationship to StoneOne Privacy Policy

These SMS Terms should be read together with the StoneOne Privacy Policy. The Privacy Policy explains the categories of personal information StoneOne collects, how information is collected and used, StoneOne's handling of mobile telephone numbers and SMS consent information, circumstances in which service providers may process information, data-security practices, data retention, applicable privacy rights, and how to contact StoneOne regarding privacy matters.

If these SMS Terms and the Privacy Policy address the same personal information, StoneOne will apply both documents in a manner consistent with applicable law.
